GoldMail, Inc. ("we," "us," or "our")
is committed to respecting the privacy rights of its customers,
visitors, and other users of the software products we offer,
including but not limited to GoldMail Studio software (Software);
services that we offer, including but not limited to GoldMail(SM)
services (collectively, the Services); and our web sites, including
but not limited to http://www.goldmail.com (the Web Sites).
We created this Privacy Policy to give you confidence and describe
how we treat personal information as you visit and use our
Software, Services and Web Sites. If you have registered or
are using such products and services as or on behalf of any
entity, you refers to the entity.

| Collection
of Personal Information |

Software and Services. You
need a GoldMail account to use the Software and Services. GoldMail,
Inc. requires some limited personal information to create a
GoldMail account, including your first name, last name, username,
e-mail address, birth year, postal code and password, which
are used to protect your account from unauthorized access.
GoldMail, Inc. also requires minimal financial information
(e.g., credit card number, expiration date, billing address,
etc.) when you seek to acquire a license for any Software or
Services, which is used exclusively for billing purposes.
GoldMail Account Manager (aka My GoldMail) stores, processes and maintains
your GoldMail messages and other data related to your GoldMail account
in order to provide Services to you. When you use the Software or Services,
certain information about your use is automatically recorded and retained,
such as account activity (e.g., storage usage, number of log-ins), data
displayed or clicked on (e.g., UI elements, ads, links), and other log
information (e.g., browser type, IP address (numbers assigned to identify
computers on the Internet), date and time of access).
When you send a GoldMail message, GoldMail, Inc. records and retains information,
including message header information, your content file(s), certain of
your GoldMail, Inc. account information and your IP address.
When you view and listen to a GoldMail message, you follow a URL to a web
page hosted by GoldMail, Inc. that plays a GoldMail viewer on that web
page downloaded to your computer or other device. GoldMail, Inc. receives
and retains the message header information, certain of your GoldMail, Inc.
account information, and your IP address, as well as content identifiers
of the content you view and the date and time of viewing.
Web Sites. We also collect information
volunteered by visitors to our Web Sites, such as
by completing and submitting our online forms or
emailing us. When visitors use our Web Sites, our
servers automatically collect certain information
that the browser sends when visiting Web sites in
general. This log file information may include the
URLs you visited; your IP address; date, time, and
time spent on pages visited; and information about
your browser and platform.
Cookies. From time to time, our
Software, Services and/or Web Sites may use the standard
cookies feature of major browser applications which
allows us to store a small piece of data on your
computer about your use of our Software, Services
and/or Web Sites. Cookies help us learn which portions
of our Software, Services and Web Sites are useful
and which need improvement, among other things. You
can choose whether to accept cookies by changing
the settings on your browser. However, if you choose
to disable this function, your experience with our
offerings may be significantly diminished and many
features may not operate. |

We use the personally identifiable
information and aggregate information we collect to maintain
your GoldMail account and market and provide the Software,
Services and Web Sites to you, to improve our offerings and
to create new offerings. We also may use your name and logo
publicly or privately in our online or offline customer lists,
presentations, advertising and promotional materials, and/or
financial reports, unless otherwise agreed in writing by us.
We do not use your personally identifiable information to send commercial
or marketing messages to you (such as offers regarding Software or Services)
without your consent or opt-in. We may send you certain service and administrative
notices, which are not subject to opt out.
For GoldMail messages, GoldMail Account Manager acts as a passive conduit
for their distribution and receipt and therefore GoldMail, Inc. will not
monitor, edit, or disclose the contents of a user's GoldMail messages except
as provided below. Recipients of GoldMail messages may forward or publicly
disclose or post URLs to GoldMail messages, the messages themselves or
their headers, content, or associated information, and this Privacy Policy
will not apply to such public information. Senders of GoldMail messages
may view, use and disclose certain information about each recipient, including
message header information, date and time of viewing, and GoldMail, Inc.
user name and IP address. Users should also be aware that certain technical
processing of and access to messages and their content may be required
to: (a) route the messages; (b) conform to connecting networks' technical
requirements; (c) prevent or minimize disruptions to Software or Services;
(d) conform to other similar requirements.
We use cookies and log file information to (a) remember your information
so that you do not need to re-enter it when using our Software, Services
and Web Sites, (b) provide personalized content; and (c) administer and
monitor usage of our Software, Services and Web Sites. We use affiliate
information in order to provide, manage and pay compensation for our marketing
and distribution arrangements. |

We do not sell, rent or otherwise
share your personal information with any third parties except
in the following limited circumstances. We may share such information
if we in good faith believe that such action is necessary to:
(a) comply with any law, regulation or order, such as subpoena,
court order or search warrant; (b) provide the Software, Services,
and/or Web Sites using our affiliates or subcontractors under
confidentiality agreement; (c) protect and defend the rights
or property of GoldMail, Inc., including investigations and
defense of third-party claims; (d) otherwise ensure compliance
with GoldMail, Inc. customer agreements and policies; and/or
(e) protect the rights, property and personal safety of GoldMail,
Inc. users, staff or the public. Your name and logo may be
publicly available as described above.
Aggregate information, such as log file information, also may be shared
with business partners and advertisers only on an anonymous aggregate basis.
GoldMail, Inc. reserves the right, in the event all or any relevant portion
of the stock, business or assets of GoldMail, Inc. is transferred to, acquired
by or merged with any third party, to transfer or assign as part of such
transaction any or all of the information we have collected. |

| Account Corrections
and Cancellation |

| You may cancel your GoldMail, Inc.
account and/or change your account settings through the Customer
Login section on www.goldmail.com. You may organize and/or
remove your stored messages using your account management feature.
Such changes generally take immediate effect. Residual copies
of deleted messages and terminated accounts may take up to
60 days to be deleted from our active servers and may remain
in our offline backup systems. However, we may retain any information
to the extent required by law or otherwise in connection with
the permitted information sharing described above. |

Sites and content on them contain links to other sites and
resources controlled by third parties. GoldMail, Inc., is not
responsible for privacy practices or content of these other
sites or resources, and you should consult the privacy statements
of such other sites and resources. GoldMail, Inc. reserves
the right to engage third party ad server companies whose policies
may govern access to any ads or links made available to you. |

Sites have security measures in place to prevent the loss,
misuse, and alteration of the information that we obtain from
you, but we make no assurances about our ability to prevent
any such loss, misuse, to you or to any third party arising
out of any such loss, misuse, or alteration. |

| We may amend this Privacy Policy,
including the use of your information for new, unanticipated
purposes, at any time by (a) posting a revised version on the
Web Sites, and/or (b) sending information regarding the amendment
to your e-mail address of record with GoldMail, Inc. You are
responsible for regularly reviewing the Web Sites to obtain
timely notice of such amendments. You shall be deemed to have
accepted such amendments by continuing to use Software, Services
and/or Web Sites after such amendments have been posted or
information regarding such amendments has been sent to you.
If you do not agree to any of such changes, you may immediately
cease all access and use of the Software, Services and Web
Sites. You agree that such termination will be your exclusive
remedy in such event. |

The Web Sites are hosted and the
Services are provided in the United States of America and are
intended for and directed to customers in that country. If
you are accessing the Web Sites or Services from the European
Union, Asia, or any other jurisdiction with laws or regulations
governing personal data collection, use, and disclosure, which
differ from United States laws, please be advised that through
your use of the Web Sites and Services, you are transferring
your personal information to the United States of America and
you consent to that transfer.
